Terms & Conditions

Last Updated: 25 September 2026

1. About These Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Arkival website, your purchase and use of digital products through the Arkival retail store, and your use of any Arkival membership or subscription service.

The website and services are operated by ARKIVAL LTD (“Arkival”, “we”, “us” or “our”), a company registered in England and Wales under company number 15517380, with its registered office at:

Office 6
251–255 Church Road
 Benfleet
Essex
United Kingdom
SS7 4QP

By placing an order, purchasing a subscription, creating an account or otherwise using our paid services, you agree to these Terms.

These Terms should be read alongside our Licence Terms, Privacy Policy and Cookie Policy, together with any product-specific information displayed on the relevant product page.

Our Licence Terms govern how Arkival assets may be used. These Terms primarily govern your relationship with Arkival, including purchases, subscriptions, accounts, payments and access to our services.

If there is any conflict between these Terms and a specific Arkival licence concerning how an asset may be used, the applicable licence will take priority in relation to that use.

Nothing in these Terms affects any rights you have under applicable consumer law that cannot lawfully be excluded or restricted.

2. Definitions

For the purposes of these Terms:

“Asset” means any digital product, file or creative resource supplied or made available by Arkival, including mockups, templates, PSD effects, textures, vectors, brushes, presets, images, graphics and other downloadable creative resources.

“Website” means the Arkival website and any associated store, member area or service operated by Arkival.

“Retail Store” means the area of the Website through which Assets and licences may be purchased individually.

“Membership” means a paid Arkival subscription providing access to the members area and eligible Assets during an active subscription.

“Subscription” means a recurring monthly, annual or other paid Membership offered by Arkival.

“Licence” means the applicable Arkival licence governing how an Asset may be used.

“Consumer” means an individual acting wholly or mainly for purposes outside their trade, business, craft or profession.

“Business Customer” means a person or organisation acting for purposes relating to their trade, business, craft or profession.

“User”, “you” or “your” means anyone accessing or using the Website, purchasing an Asset or holding an Arkival account or Membership.

3. Accounts

Certain areas of Arkival may require you to create an account.

You are responsible for providing accurate information, keeping your login details secure and ensuring that your account is used in accordance with these Terms and the applicable Licence.

Unless expressly stated otherwise, an Arkival Membership is intended for one registered user.

You must not share your account credentials with other individuals, businesses or organisations or otherwise allow unauthorised users to access the Membership through your account.

Where a Membership is purchased by a business or agency, the Standard Subscription Licence governs the permitted in-house use of downloaded Assets. This does not turn a single-user Arkival account into a multi-user account unless Arkival expressly agrees otherwise.

You must not create multiple accounts for the purpose of avoiding restrictions, payment obligations, Licence restrictions or enforcement action.

If you believe somebody has accessed your account without permission, please contact us.

4. Our Digital Products

Arkival supplies digital creative Assets.

Unless expressly stated otherwise, all Assets are supplied electronically. No physical product will be delivered.

Product pages may specify information including file type, dimensions, resolution, contents, required software, compatibility and other relevant characteristics.

You are responsible for reviewing the product information and any stated software requirements before purchasing or downloading an Asset.

Purchasing or downloading an Asset does not transfer ownership or copyright in that Asset to you.

Instead, you receive the right to use the Asset in accordance with the applicable Arkival Licence.

5. Retail Store Purchases

Assets may be purchased individually through the Arkival Retail Store.

The applicable price and available Licence options will be displayed before purchase.

Where different Licence options are available, you are responsible for selecting the Licence appropriate to your intended use.

When you submit and pay for an order, you are offering to purchase the relevant digital product and Licence. Once the order is accepted and the digital content is supplied or made available, a contract exists between you and Arkival.

We may refuse or cancel an order where reasonably necessary, including where:

  • payment has not been authorised;

  • we reasonably suspect fraud or unauthorised payment activity;

  • an obvious pricing or listing error has occurred;

  • the Asset is no longer available;

  • we are legally prevented from completing the transaction; or

  • the Website or checkout has been deliberately misused.

If we cancel an order after taking payment and the relevant digital content or Licence has not been supplied, we will refund the amount paid for that order.

6. Prices and Payment

Prices are displayed on the Website before purchase.

Any applicable taxes or mandatory charges will be displayed or calculated as required before the transaction is completed.

Payments are processed through the payment services made available through our ecommerce platform and its supported payment providers.

You must provide valid payment information and be authorised to use the payment method supplied.

We may change prices for future purchases at any time.

A change in price will not retrospectively alter the price of a completed one-off purchase.

7. Membership and Subscriptions

Arkival may offer monthly, annual or other recurring Membership plans.

The price and billing frequency applicable to a Subscription will be displayed before you subscribe.

Unless expressly stated otherwise, Subscriptions automatically renew at the end of each billing period until cancelled.

For example, a monthly Subscription renews monthly and an annual Subscription renews annually.

By starting a Subscription, you authorise our payment provider to charge the applicable Subscription fee to your chosen payment method on each renewal date until you cancel.

Membership gives you access to the features and Assets included in your applicable plan while your Subscription remains active.

Membership does not transfer ownership of the Arkival library or any Asset to you.

8. Subscription Pricing

The price applicable when you subscribe will be displayed before purchase.

Arkival may offer promotional or introductory Subscription prices.

Where an introductory or promotional price applies only for a limited period, the subsequent recurring price will be displayed or communicated as part of the offer.

We may change Subscription prices from time to time.

Any new price will not retrospectively change a billing period that you have already paid for.

Where the recurring price of an existing Subscription is changed, we will provide appropriate notice before the new price takes effect where required by law.

9. Cancelling a Subscription

You may cancel your Subscription through the subscription management functionality available through your Arkival account.

Cancellation stops future renewal charges.

Unless otherwise stated or required by law, your Membership will remain active until the end of the billing period you have already paid for, after which access will end.

Cancellation does not retrospectively cancel or refund a billing period that has already been supplied, except where you have a legal right to a refund.

If a recurring payment fails, access to the Membership may be suspended and the Subscription may ultimately be cancelled if payment cannot be collected.

Your statutory rights are unaffected.

10. Assets Downloaded Through Membership

Assets downloaded through an active Membership are supplied under the Arkival Standard Subscription Licence unless expressly stated otherwise.

The Standard Subscription Licence determines what you may and may not do with those Assets.

Cancelling your Membership prevents you from downloading new Membership Assets once your paid access ends.

Assets legitimately downloaded while your Membership was active may remain stored on your device following cancellation, subject at all times to the Licence under which they were downloaded.

Cancellation does not transfer ownership of an Asset or remove the restrictions contained in the applicable Licence.

You should retain your own copies of Assets you are entitled to keep. Arkival does not guarantee that every Asset will remain available for re-download indefinitely.

11. Licensing and Commercial Use

All use of Arkival Assets is governed by our applicable Licence Terms.

Membership Assets are supplied under the Standard Subscription Licence unless expressly stated otherwise.

The Standard Subscription Licence covers the uses set out in that Licence, including permitted personal and in-house use and use within client presentations.

Where an Asset will be used in final commercial client work or another use requiring broader rights, the appropriate Commercial MINI or Commercial MAX Licence must be purchased separately through the Arkival Retail Store where applicable.

Downloading an Asset through Membership does not automatically grant Commercial MINI or Commercial MAX rights.

You are responsible for ensuring that your intended use is permitted by the Licence you hold.

If these Terms and the applicable Licence deal with the same issue concerning use of an Asset, the specific Licence terms take priority in relation to that use.

12. Digital Content, Cancellation Rights and Refunds

Arkival Assets are digital content and are normally supplied or made available immediately following purchase or through an active Membership.

Consumers may have statutory cancellation rights under applicable law.

Where you expressly request or consent to the immediate supply of digital content during a statutory cancellation period and acknowledge that your right to cancel will be lost once supply begins, your statutory cancellation right in relation to that digital content may end once supply begins.

Because digital Assets can be supplied immediately and cannot meaningfully be returned once downloaded, we do not generally provide refunds for a change of mind after supply has begun where the law permits us to do so.

This does not affect your statutory rights.

If you are a Consumer, digital content supplied by Arkival must meet the standards required by applicable consumer law. This includes requirements relating to satisfactory quality, fitness for an applicable particular purpose and conformity with its description.

If an Asset is faulty, corrupted, materially different from its description or otherwise fails to meet your statutory rights, please contact us so that we can investigate and provide any remedy to which you are legally entitled.

Nothing in these Terms excludes, limits or replaces any statutory right or remedy that cannot lawfully be excluded.

13. Digital Delivery and Downloads

Assets are delivered electronically through download links, direct downloads, account access or other electronic delivery methods.

You are responsible for ensuring that you have a suitable internet connection, sufficient storage space and any compatible software or hardware stated as necessary for the Asset.

If a supplied file appears to be corrupted or a download fails, please contact us so that we can investigate.

You are responsible for maintaining appropriate backups of Assets that you are entitled to retain.

Although Arkival may allow Assets to be downloaded again, we do not promise permanent hosting or perpetual re-download availability for every Asset.

This does not affect any statutory obligation to supply digital content or provide a remedy where required by law.

14. Software and Compatibility

Some Arkival Assets require third-party software, such as Adobe Photoshop, Adobe Illustrator or other creative applications.

Required software or important compatibility information will normally be stated on the applicable product page.

Third-party software is not supplied by Arkival unless expressly stated otherwise.

You are responsible for obtaining any required third-party software and the appropriate licence or subscription for that software.

Arkival cannot guarantee that an Asset will remain compatible with every future version of third-party software, operating system or device where the relevant third-party provider subsequently changes its software or technology.

This does not affect your statutory rights concerning the description, functionality or compatibility represented by Arkival when the Asset was supplied.

15. Changes to the Arkival Library

Arkival is a developing creative platform and the Membership library will change over time.

We may add new Assets, update existing Assets, replace files, correct errors, change categories or organisation, update previews and descriptions, or retire and remove Assets where reasonably necessary.

Membership does not guarantee that every Asset available when you join will remain available indefinitely.

Removal of an Asset from the Membership library does not by itself terminate a Licence already legitimately granted for a downloaded Asset, unless otherwise provided by the applicable Licence or removal is legally necessary.

16. Intellectual Property

The Arkival Website, Arkival branding, original Assets, product imagery, previews, graphics and other original content are protected by copyright, trade mark and other intellectual property laws.

Arkival owns or has obtained the rights necessary to make the relevant content available.

Some content may have been created by contributors or other rights holders and made available to Arkival under an assignment, licence or other contractual arrangement.

Purchasing or downloading an Asset grants you a Licence to use it. It does not transfer copyright or ownership of the Asset to you.

Except where expressly permitted by an applicable Licence or by law, you must not:

  • resell or redistribute Arkival Assets as standalone files;

  • share source Assets with unauthorised users;

  • make Assets publicly available for download;

  • sublicense Assets;

  • claim ownership or authorship of Arkival Assets;

  • use Assets to create or reproduce a competing digital asset library; or

  • otherwise exploit Arkival Assets outside the rights granted by your Licence.

17. Third-Party Brands and Content

Some Assets, product previews or example designs may depict third-party products, trademarks, packaging, locations, artwork or other material for demonstration or presentation purposes.

Unless expressly stated otherwise, the appearance of a third-party brand or product does not imply sponsorship, endorsement or affiliation with Arkival.

An Arkival Licence grants rights only in material that Arkival owns or is authorised to license.

It does not grant rights in third-party trademarks, artwork, brands or other intellectual property that Arkival does not own or control.

You are responsible for ensuring that your final use of an Asset, including any material you add to it, does not infringe third-party rights.

18. Prohibited Use

You must not:

  • use Arkival or its Assets for unlawful purposes;

  • redistribute or resell Assets except where expressly permitted by the applicable Licence;

  • share Membership credentials with unauthorised users;

  • bypass Membership, payment or download restrictions;

  • scrape or systematically extract content from the Website;

  • use bots, scripts or automated systems to mass-download Assets;

  • make a substantial part of the Arkival library available to another person or service;

  • attempt to gain unauthorised access to another account or Arkival’s systems;

  • interfere with the operation or security of the Website; or

  • use Arkival in a way that materially infringes our intellectual property or the rights of another person.

Normal downloading of Assets for genuine use permitted by your Licence is allowed.

19. Artificial Intelligence and Machine Learning

Unless expressly permitted by Arkival, Arkival Assets must not be used:

  • as training data for an artificial intelligence or machine-learning model;

  • to train or fine-tune a generative model;

  • as part of a dataset intended for model training;

  • to build or improve a competing generative asset system; or

  • for systematic machine-learning extraction or ingestion.

This does not prohibit ordinary creative use of AI-enabled software where an Arkival Asset is used as part of a permitted creative workflow or final project and is not being used to train, fine-tune or build a model or dataset.

All such use must still comply with the applicable Arkival Licence.

20. Promotions and Discount Codes

Arkival may offer promotional pricing, introductory offers, launch offers or discount codes from time to time.

Any material conditions applying to an offer will be stated with the promotion.

Unless expressly stated otherwise, promotional codes cannot be exchanged for cash and may be restricted to particular customers, products, plans or periods.

Where a Subscription begins at a temporary promotional price and subsequently renews at another price, the applicable recurring price will be communicated as part of the offer.

We may refuse use of a promotion where there is reasonable evidence of fraud, deliberate technical exploitation or use contrary to clearly stated promotional conditions.

21. Third-Party Services

Arkival relies on third-party providers to operate parts of the Website and our services.

These may include providers of website and ecommerce infrastructure, payment processing, digital storage and content delivery, analytics and communications.

The availability of some Arkival functionality may therefore depend on services outside our direct control.

Further information about third parties that process personal information is provided in our Privacy Policy and Cookie Policy where applicable.

22. Website Availability

We aim to keep Arkival and its download services available and functioning correctly, but we cannot guarantee uninterrupted or error-free access at all times.

Access may occasionally be interrupted because of maintenance, software updates, security work, infrastructure failures, internet disruption, third-party service outages or circumstances outside our reasonable control.

We will take reasonable steps to restore affected services where practicable.

Nothing in this section limits any statutory right or remedy you may have where a paid service has not been supplied as required by law.

23. Suspension and Termination

We may suspend or terminate an account or Membership where we reasonably believe that:

  • these Terms have been materially breached;

  • an Arkival Licence has been materially breached;

  • account credentials have been improperly shared;

  • Assets are being redistributed without permission;

  • automated or abusive downloading is taking place;

  • payment remains outstanding;

  • fraudulent or unlawful activity has occurred;

  • the account presents a genuine security risk; or

  • suspension or termination is required by law.

Where appropriate and reasonably possible, we may give you an opportunity to remedy a breach before permanently terminating your account.

Serious infringement, deliberate circumvention, fraud, security threats or unlawful activity may result in immediate suspension or termination.

Termination does not remove intellectual property or Licence restrictions that are intended to continue after access ends.

Your statutory rights remain unaffected.

24. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Consumers

If you are a Consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill where applicable.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

Nothing in these Terms excludes or restricts mandatory rights or remedies available to Consumers under applicable law.

Business Customers

If you are a Business Customer, to the fullest extent permitted by law, Arkival will not be liable for indirect or consequential losses or for loss of profit, revenue, business, contracts, anticipated savings, goodwill or business opportunity arising from your use of the Website or Assets.

Except for liability that cannot lawfully be limited, Arkival’s total aggregate liability arising from a particular Retail Store purchase will not exceed the amount paid to Arkival for the purchase giving rise to the claim.

For a claim arising specifically from a paid Subscription, except for liability that cannot lawfully be limited, Arkival’s total aggregate liability will not exceed the Subscription fees paid by you to Arkival during the 12 months immediately preceding the event giving rise to the claim.

25. Events Outside Our Reasonable Control

Arkival will not be responsible for delay or failure to perform an obligation where this results from circumstances genuinely outside our reasonable control.

These may include widespread internet or infrastructure failures, major third-party platform failures, natural disasters, fire, flood, war, civil emergency, government action, widespread cyberattack or similar events.

We will take reasonable steps to minimise disruption where practicable.

This section does not remove mandatory rights available to Consumers.

26. Privacy and Cookies

Our collection and use of personal information is governed by our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy and any cookie controls made available through the Website.

These documents should be read alongside these Terms.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to Arkival, our products and services, technology, security requirements, business operations or applicable law.

The current version will be published on the Website together with the date it was last updated.

Changes will generally apply to future use, purchases and Subscription periods.

Where a change materially affects an existing paid Subscription or contractual right, we will provide any notice required by applicable law.

Changes to these Terms do not retrospectively remove rights already granted under an applicable Licence unless the Licence itself lawfully permits the relevant change.

28. Complaints and Contact

If you experience a problem with an Asset, order, Membership, account or payment, please contact us through the Contact page on the Arkival Website.

Please provide enough information for us to identify the relevant order, account or Subscription and investigate the issue.

We aim to deal with genuine customer issues fairly and within a reasonable period.

29. Governing Law and Jurisdiction

These Terms and contracts entered into through Arkival are governed by the laws of England and Wales.

If you are a Consumer resident elsewhere, this does not deprive you of mandatory consumer protections that apply to you and cannot lawfully be excluded.

If you are a Business Customer, the courts of England and Wales will have exclusive jurisdiction over disputes arising from or connected with these Terms, the Website, a purchase or a Subscription, unless otherwise agreed in writing.

If you are a Consumer, nothing in these Terms is intended to restrict any mandatory right you may have to bring proceedings in the courts applicable to where you live.

30. General

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

You may not transfer your account, Membership or Licence to another person except where the applicable Licence expressly permits it or Arkival agrees otherwise.

We may transfer our rights and obligations under these Terms as part of a genuine sale, transfer, merger or restructuring of our business, provided that doing so does not reduce any mandatory rights you have.

Except where expressly stated otherwise, a person who is not a party to the contract between you and Arkival has no right to enforce these Terms.

These Terms, together with the applicable Arkival Licence and any terms expressly incorporated into a transaction, form the agreement between you and Arkival concerning that transaction.

Nothing in this section excludes liability for fraud or fraudulent misrepresentation or restricts rights that cannot legally be excluded.
